Challenging Homelessness Decisions Print E-mail
The Housing (Amendment) Act (NI) 2010 introduces one of the most significant changes to homeless legislation, (Housing (NI) Order 1988) for many years.  At present, an applicant who is unhappy with the decision on their homelessness status, can appeal through NIHE internal process.  The Act establishes an independent means of review, with a right of appeal to the County Court.

Whilst challenging homeless decisions has always been a key task for advisers, the importance of understanding the appeal process is now enhanced. To be successful on behalf of a client, advisers need to be fully aware of the homelessness legislation; be able to identify inadequate decisions; determine points of law in a client’s case and effectively use legislation to advocate in writing on behalf of clients.


The course will enable advisers to:
  • Understand the Housing (Amendment) Act (NI) 2010
  • Have the skills and knowledge to identify points of law in a clients case
  • Prepare a 1st stage review letter for a client
  • Work with legal advisers on a 2nd stage appeal at County Court

Who Should Attend?
This course requires a good working knowledge of the Housing (NI) Order 1988 the (homeless legislation).
