Mortgage Possession Proceedigns Print E-mail

As the number of repossessions in Northern Ireland continues to rise, it is vital that advisers have the necessary knowledge and skills to represent clients who are faced with the prospect of losing their homes due to mortgage arrears.

This two day course will consider the possession process in detail focusing on the powers of the High Court, the regulation of the mortgage contract and the use of legislation and case law to ensure that advisers can provide effective advocacy and representation for clients whose lenders have commenced legal proceedings.

In particular this course will include:

  • The possession process in Northern Ireland
  • Identifying strategies to avoid repossession
  • The regulation of the mortgage contract
  • Discretion of the court under the Administration of Justice Acts 1970 & 1973 and orders that may be granted
  • Defences that may be available to the borrower
  • Secured loans under the Consumer Credit Act 1974
  • Understanding actions that an adviser can take to stay enforcement of an order
  • Advising a client on the re-housing options relating to homelessness & intentionality
