Letting Fees in Northern Ireland

Recent court judgments have brought fresh attention to The Commission on Disposals of Land (Northern Ireland) Order 1986, a piece of legislation which appears to restrict the levying of certain letting fees to new and prospective tenants.

This guide looks at the following:

  • established fee-charging practice within the letting industry
  • the law on letting fees
  • recent court cases challenging the validity of such fees
  • what fees can be recovered under the provisions of the Commission on Disposals of Land (NI) Order 1986
  • how other jurisdictions are tackling the issue of upfront fees in the private rented sector.
